Gates is apparently looking at ways to not enforce DADT under certain circumstances. If the service member didn't actually out themselves, and wasn't discovered to be gay by the military police by accident, but was instead outed by a jealous ex or someone else acting maliciously, then they might let that person continue to serve quitely, because they didn't "tell" and no-one "asked".
