The Tenth Amendment
Apr. 1st, 2010 01:32 pmI heard a discussion yesterday on the radio about the Tenth AmendmentMovement. Never had heard of it, though of course I know what the tenth amendment says (basically, the federal government can only do what the Consitution says it can; anything else not mentioned in the constitution remains under the control of the individual states). Well today on the morning news, I saw Jonathan Turley, a legal scholar and law Professor discussing the health bill and the 10th amendment. His article here:

suggests there may be real challenges based on the tenth amendment over the provisions in the bill mandating the purchase of insurance. I don't know about the constitutionality, but I do think it's inappropriate to require Americans to buy insurance from private organizations, with no public option available. The lawsuits pending on this legislation should prove very interesting...
